These Terms of Service (the “Terms”) govern your access to and use of www.skybearstandards.com (the “Site”), which is owned and operated by Sky Bear Technical Standards Inc. (“Sky Bear,” “we,” “us,” or “our”). The Site is an e-commerce platform through which customers may purchase or access technical standards, industry codes, specifications, and related publications. By accessing the Site, creating an account, or purchasing content through the Site, you agree to be bound by these Terms.
1. Accounts and Eligibility
If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information, including payment information where applicable, and to keep that information up to date.
You must notify us promptly of any unauthorized use of your account or any security breach. We may suspend, restrict, or terminate your account or access to the Site if we reasonably believe you have violated these Terms, misused the Site, or engaged in unlawful activity.
2. Intellectual Property and Licensed Content
All technical standards, codes, specifications, data, and related materials made available through the Site (collectively, the “Content”) are protected by Canadian and international copyright and intellectual property laws and remain the property of the applicable publisher, ISO, ISO member body, or other rights holder. Sky Bear is an authorized distributor or reseller of certain Content and provides access to that Content subject to the licensing, copyright, and use restrictions established by the applicable publisher, ISO member body, appointing standards body, or authorized distribution framework. All Content is licensed, not sold. Any reference to purchase or sale refers only to the grant of a limited, non-exclusive, non-transferable licence to use the Content in accordance with the applicable terms and restrictions, and does not transfer any ownership or copyright interest to you.
Unless otherwise stated in writing or expressly permitted by the applicable publisher, ISO member body, or other rights holder, Content is provided solely for the internal business use of the licensed user or licensed organization, as applicable, and only within the scope of the specific licence purchased. Any rights to print, download, view offline, access Content on multiple devices, or make Content available to additional users are limited to the rights expressly included with the applicable product and are subject to any publisher-imposed, ISO-imposed, or member-body-imposed restrictions disclosed at the time of purchase or access.
Except where expressly permitted, you may not copy, reproduce, redistribute, sublicense, post, transmit, disclose, share externally, forward, store in a shared repository, upload to an intranet, cloud storage system, collaboration platform, or other shared environment, or otherwise make Content available to any third party or to users beyond the scope of the applicable licence. You may not share account credentials, access links, downloaded files, or other means of access to Content except as expressly authorized. You are responsible for reviewing, understanding, and complying with all publisher-specific, ISO-specific, member-body-specific, and product-specific licensing terms and restrictions that apply to the Content you purchase or access through the Site.
You may not upload, submit, ingest, use, or permit any Content to be used in connection with artificial intelligence, machine learning, text and data mining, or similar systems except to the extent expressly authorized by the applicable publisher or by written permission from Sky Bear where permitted. You may not remove, disable, circumvent, interfere with, or attempt to defeat any watermark, notice, security feature, access control, digital rights management measure, device limit, or technical protection measure associated with the Content or the Site. On reasonable request, you agree to provide information reasonably necessary to confirm your compliance with applicable licence terms.
3. Products, Orders, and Availability
We offer technical standards, industry codes, and related digital publications through the Site. Product descriptions, availability, release information, licensing scope, and related details are provided for general information only and may change without notice.
We make reasonable efforts to present accurate product information, but we do not guarantee that all listings, descriptions, previews, licensing summaries, or availability details are complete, current, or error-free. All purchases are made at your own discretion and remain subject to publisher availability, applicable licensing conditions, and any requirements imposed by the applicable publisher, ISO member body, appointing standards body, or authorized distribution framework.
We reserve the right to refuse, cancel, limit, or reverse any order or request for access where the intended use, delivery method, user scope, or other circumstances are inconsistent with the licence applicable to the Content, including any restrictions imposed by the publisher, ISO member body, appointing standards body, or authorized distribution framework.
4. Pricing and Payment
Prices are displayed in the currency indicated on the Site and may change without notice. We accept payment by cheque or check, credit card, e-transfer, debit, and direct debit. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us to charge the applicable amount for your order or subscription.
We reserve the right to refuse, cancel, or reverse any order or transaction if we reasonably believe that the transaction is unauthorized, violates applicable law, breaches these Terms, or cannot be fulfilled due to licensing or availability limitations.
5. Refunds and Returns
Unless required by applicable law, all sales are final. Because the Content made available through the Site is proprietary and typically supplied in digital or licensed form, we do not offer returns, exchanges, or refunds once an order has been processed or access has been granted. You are responsible for confirming that you are purchasing the correct product and edition before completing your order.
6. Subscriptions
If you purchase a subscription product, your subscription does not automatically renew unless expressly stated otherwise at the time of purchase. Before any renewal or continuation payment is processed, you will be notified and must authorize the payment for the subscription to continue.
7. Third-Party Publishers and Materials
Many products offered through the Site originate from third-party publishers, ISO member bodies, standards organizations, or other rights holders. While Sky Bear is an authorized distributor or reseller for certain products, we do not create the underlying publisher content and cannot guarantee the completeness, accuracy, technical performance, or fitness of third-party materials for your particular purpose. Your use of such materials may also be subject to separate publisher, ISO, member-body, or product-specific terms, policies, restrictions, and technical controls.
Where Content is subject to publisher, ISO, member-body, or product-specific restrictions, those restrictions apply in addition to these Terms. If there is any conflict between these Terms and a product-specific licensing restriction or access control applicable to particular Content, the more restrictive condition will apply to the extent permitted by law. If we believe that your payment, order, or use of Content has violated applicable law, these Terms, or the applicable licensing framework, we reserve the right to cancel or reverse your transaction and suspend or restrict access.
8. Disclaimers and Consumer Rights
The Site and all Content are provided on an “as is” and “as available” basis, without warranties of any kind except as required by law. We do not guarantee uninterrupted access, compatibility with every device or system, or that all Content will be free from errors, omissions, or publisher changes. Nothing in these Terms limits any non-waivable rights or remedies you may have under applicable consumer protection legislation.
9. Limitation of Liability
To the fullest extent permitted by law, Sky Bear Technical Standards Inc. and its directors, officers, employees, agents, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business opportunity, or goodwill arising from or related to your use of the Site, your purchase or use of Content, or any third-party publisher materials.
10. Indemnity
Except where prohibited by law, you agree to indemnify and hold harmless Sky Bear Technical Standards Inc. and its directors, officers, employees, agents, affiliates, and service providers from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or related to your breach of these Terms, misuse of the Site, or violation of any applicable law or third-party rights.
11. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict of law principles.
12. Access and Digital Rights Management
Content may be delivered through secure PDF, web viewer, or other controlled access formats. Access may be subject to technical protection measures, including digital rights management controls, which form part of the applicable licence terms and are intended to support compliance with those terms.
Access methods, device limits, printing permissions, download permissions, offline viewing periods, and other technical controls form part of the applicable licence terms. Unless otherwise stated at the time of purchase, device limits may apply, including up to three devices for secure PDF access and up to three devices for web browser access. Printing may be limited to a single copy where permitted, and some publishers may prohibit printing entirely. Single-user purchases generally do not expire unless otherwise specified, and offline access may be available for limited periods, such as up to one week, depending on the product and publisher settings.
You may not bypass, disable, interfere with, or attempt to evade any access control, device limitation, printing restriction, watermark, security feature, or digital rights management measure applied to the Content or the Site. We may impose, modify, suspend, or revoke access methods or technical controls where required by the applicable publisher, ISO member body, appointing standards body, or authorized distribution framework, or where reasonably necessary to protect licensed Content or address suspected misuse.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Site, our services, applicable law, or publisher requirements. Any updated version will be posted on the Site, and your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
